These Terms & Conditions govern your use of this website and any purchases made from it.

This website is owned and operated by Jan Click Flooring Wholesale Ltd, trading as The Artificial Grass Company Nationwide (“we”, “our”, “us”).

By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please do not use this website.

These Terms should be read together with our Privacy Policy, Shipping & Delivery Policy, Returns & Refund Policy and Cookie Policy. Together these documents form the agreement between you and us.

Nothing contained within these Terms affects your statutory rights under the laws of England and Wales.

2. Eligibility

By placing an order you confirm that:

• You are at least 18 years old.

• The information you provide is accurate.

• You are legally capable of entering into a binding contract.

If purchasing on behalf of a company or organisation, you confirm that you have authority to bind that business.


3. Products

We sell artificial grass, accessories and related products through this website.

We take reasonable care to ensure that all product descriptions, photographs, specifications and prices are accurate.

However:

• Colours displayed on screens may vary from actual products.

• Manufacturing batches may differ slightly.

• Grass fibres naturally lay in different directions.

• Artificial grass may appear lighter or darker depending on lighting conditions and viewing angle.

• Samples are provided as a guide only.

These are normal characteristics of artificial grass and do not constitute manufacturing defects.


4. Product Variations

Artificial grass is manufactured in production batches.

Although we make every effort to match colours between orders, we cannot guarantee an exact colour match where:

• separate orders are placed;

• different roll widths are used;

• products come from different manufacturing batches.

If colour consistency is essential, please contact us before placing your order.


5. Measurements

Customers are responsible for ensuring all measurements are correct before ordering.

We strongly recommend allowing for trimming and fitting.

If you are unsure, please contact us before ordering.

Products cut specifically to your requested length are considered bespoke goods.


6. Samples

Samples are intended to help customers assess colour, texture and quality.

Due to manufacturing tolerances and production batches, full-size products may differ slightly from samples received.


7. Pricing

All prices displayed on this website are in Pounds Sterling (£).

Prices include VAT where applicable unless otherwise stated.

Although every effort is made to ensure prices are correct, occasional errors may occur.

If we discover an incorrect price after your order has been placed, we will contact you before processing the order.

You may then choose to:

• continue with the order at the correct price; or

• cancel your order and receive a full refund.

We reserve the right to change prices at any time before an order is accepted.


8. Placing an Order

Submitting an order through our website constitutes an offer to purchase goods.

Receiving an automated order confirmation email does not mean your order has been accepted.

Every order is checked for:

• payment authorisation;

• stock availability;

• delivery availability;

• pricing accuracy; and

• fraud prevention.

A legally binding contract is formed only once we have accepted your order for processing.

If we cannot accept your order for any reason, we will notify you and issue a full refund where payment has already been received.


9. Payment

Payment is taken securely when your order is placed.

We accept payment methods displayed at checkout.

Orders will not be processed until payment has been successfully authorised.

Where payment is made using PayPal, the transaction is also subject to PayPal’s own Terms and Conditions.

We reserve the right to refuse or cancel any order where fraudulent activity is suspected.


10. Availability

All products are offered subject to availability.

Occasionally stock levels may differ from those shown online.

If a product becomes unavailable after an order is placed, we will contact you promptly and provide either:

• a full refund;

• an alternative product; or

• an agreed delayed delivery.

The choice will always be yours.

 

11. Delivery

Delivery times displayed on our website are estimates only and are not guaranteed unless expressly agreed in writing.

While we make every reasonable effort to deliver within the estimated timeframe, delays may occur due to circumstances beyond our control, including adverse weather, traffic, courier delays, supplier delays or other unforeseen events.

We shall not be liable for any loss arising from delayed delivery where the delay is outside our reasonable control.

Please ensure someone is available to accept delivery where required.

If delivery cannot be completed because no one is available, additional delivery charges may apply for a re-delivery.

12. Delivery Inspection

Customers should inspect all goods as soon as reasonably possible after delivery.

If goods are received damaged, incomplete or incorrect, you should notify us within 48 hours of delivery and, where possible, provide photographs of the issue.

This does not affect your statutory rights where goods are faulty, not as described or not fit for purpose.


13. Risk and Ownership

Risk in the goods passes to you when the goods are delivered to the delivery address provided.

Ownership of the goods remains with Jan Click Flooring Wholesale Ltd until full payment has been received.


14. Bespoke and Cut-to-Length Products

Many of our products, including artificial grass cut to a customer’s requested length, are made to the customer’s individual specification.

Under the Consumer Contracts Regulations 2013, bespoke or personalised goods are generally exempt from the statutory 14-day cancellation right.

Once production or cutting has commenced, these orders cannot normally be cancelled or returned unless the goods are faulty, damaged, or not as described.

This does not affect your statutory rights.


15. Cancelling an Order

Orders may be cancelled before processing begins by contacting us as soon as possible.

Once a bespoke order has entered production or has been cut to your requested size, cancellation may no longer be possible.

If cancellation is accepted after processing has begun, any costs already incurred may be deducted from any refund where permitted by law.


16. Returns

Our Returns & Refund Policy explains when products may be returned.

Customers remain fully protected by their statutory rights under the Consumer Rights Act 2015.

Nothing within these Terms limits those rights.


17. Faulty, Damaged or Incorrect Goods

If goods supplied are faulty, damaged upon arrival, or materially different from those ordered, please contact us as soon as reasonably possible.

Where goods are confirmed to be faulty, not as described or not fit for purpose, we will provide an appropriate remedy in accordance with UK consumer law.

Depending on the circumstances, this may include:

• repair;

• replacement;

• price reduction; or

• refund.

We may request photographs or inspect the goods before determining the appropriate remedy.


18. Installation

Customers are responsible for ensuring products are suitable before installation.

We strongly recommend inspecting all goods before fitting or cutting.

We cannot accept responsibility for installation costs, labour charges or consequential losses where products have been installed before any defect has been reported.

Nothing in this clause limits your statutory rights where required by law.


19. Artificial Grass Characteristics

Artificial grass is a manufactured pile product.

Normal characteristics include:

• shading;

• pile flattening;

• visible joining lines where multiple pieces are installed;

• variations in pile direction;

• temporary creases resulting from transportation;

• colour variation between manufacturing batches;

• changes in appearance depending upon lighting conditions.

These characteristics are not manufacturing defects.


20. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence;

• fraud or fraudulent misrepresentation;

• defective products where liability cannot legally be excluded; or

• any other liability that cannot legally be excluded under English law.

Subject to the above, we shall not be liable for:

• indirect loss;

• consequential loss;

• loss of profits;

• loss of business;

• loss of contracts;

• loss of goodwill; or

• losses that were not reasonably foreseeable at the time the contract was formed.

Our total liability shall not exceed the purchase price paid for the goods except where the law provides otherwise.


21. Force Majeure

We shall not be responsible for delays or failure to perform our obligations where such delay or failure results from events beyond our reasonable control.

These events include but are not limited to:

• severe weather;

• flooding;

• fire;

• industrial disputes;

• transport disruption;

• shortages of raw materials;

• supplier failure;

• government restrictions;

• acts of terrorism;

• pandemics; or

• any other event beyond our reasonable control.

We will make reasonable efforts to minimise any disruption.


22. Website Use

You agree not to:

• misuse this website;

• introduce viruses or malicious software;

• attempt unauthorised access to our systems;

• interfere with website security;

• copy website content without permission; or

• use the website for unlawful purposes.

We reserve the right to suspend or terminate access where misuse is identified.


23. Intellectual Property

All website content including:

• logos;

• graphics;

• photographs;

• product descriptions;

• videos;

• text;

• page layouts; and

• designs

remain the property of Jan Click Flooring Wholesale Ltd or its licensors.

No content may be copied, reproduced or distributed without our prior written consent.


24. Privacy

We process personal information in accordance with UK data protection legislation.

25. Changes to these Terms

We reserve the right to update these Terms & Conditions from time to time.

Changes will take effect immediately upon publication on this website.

The Terms in force at the time your order is placed will apply to that order.

 

26. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales unless applicable consumer law provides otherwise.
